These terms and conditions (collectively, hereinafter referred to as the "Terms") govern your ("User") access to and use of the website, www.qbust.com and the QBust mobile applications ("Website"). The Website is owned, managed and operated by Reksys Technology solutions.
This mobile application (the “App”) is made available by Reksys Tech , a company limited.. The user of the App, confirm your acceptance of these App terms of use (“App Terms”). If you do not agree to these App Terms, you must immediately uninstall the App and discontinue its use. These App Terms should be read alongside our Privacy Policy and Cookie Policy.
Depending on the version of the Application you have downloaded, these App Terms incorporate Apple’s or Google Android’s terms and condition and privacy policies (“Platform Terms”). If there is any conflict between these App Terms and the Platform Terms then these App Terms will prevail.
We may vary from time to time of these App Terms. Please check these App Terms regularly to ensure you are aware of any variations made by us. If you continue to use this App, you are deemed to have accepted such variations. If you do not agree to such variations, you should not use the App.
Use of the App
Reksys Technology hereby grants you a non-exclusive, non-transferable, revocable licence to use the App for your personal, non-commercial use and only on an Apple or Android device (“Device”) as permitted by the applicable Platform Terms and in accordance with these App Terms (“User Licence”). All other rights in the App are reserved by Reksys Tech. In the event of your breach of these App Terms we will be entitled to terminate the User Licence immediately. You acknowledge that your agreement with your mobile network provider (“Mobile Provider”) will apply to your use of the App. You acknowledge that you may be charged by the Mobile Provider for data services while using certain features of the App . You acknowledge that where you use services provided by Apple or Google (or any other third parties) in connection with your use of the App, you will be subject to Apple’s, Google’s (or the applicable third party’s) terms and conditions and privacy policy and you should ensure that you have read such terms.
Intellectual Property
Content included on the App & Website, such as text, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property of Reksys Technologies, its affiliates or its content suppliers and is protected by Indian and international copyright and database right laws. The compilation of all content on this Website is the exclusive property of Reksys and its affiliates and is protected by laws of India and international copyright and database right laws. You may not systematically extract/ re-utilise any parts of the contents of the Website without our express written consent. You cannot use the reksys trademarks for commercially exploiting them for Your interests without our express permission. We reserve the right to initiate legal proceedings if we discover any infringement of our intellectual property rights.
Prohibited Uses
You agree not to use the App in any way that:
1) is unlawful, illegal or unauthorised;
2) is defamatory of any other person;
3) is obscene or offensive;
4) promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation or age;
5) infringes any copyright, database right or trade mark of any other person;
6) is likely to harass, upset, embarrass, alarm or annoy any other person;
7) is likely to disrupt our service in any way; or
8) advocates, promotes or assists any unlawful act such as (by way of example only) copyright infringement or computer misuse.
Representation and warranties
• By Using This Website You Represent And Warrant That:
• You are 18 years of age or older and that Your use of the Website shall not violate any applicable law or regulation;
• All registration information You submit is truthful and accurate and that You agree to maintain the accuracy of such information;
• You as a Registered or Non-Registered User will use the Website solely for Your personal and non-commercial use. Any use of this Website or its content other than for personal purposes is prohibited.
• Your use of this Website shall be subjected to the following restrictions:
• You will not delete or modify any content of the Website including but not limited to, legal notices, disclaimers or proprietary notices such as copyright or trademark symbols, logos, that You do not own or have express permission to modify;
• You will not decompile, reverse engineer, or disassemble the content, or
• You will not remove any copyright, trademark registration, or other proprietary notices from the Website. You further agree not to access or use this Website in any manner that may be harmful to the operation of this Website or its content.
• You will not use the Website and / or services in any way that is unlawful, or harms the Company or any other person or entity, as determined in the Company's sole discretion.
• You will not engage in any form of antisocial, disrupting, or destructive acts, including "flaming", "spamming", "flooding", "trolling", "phishing" as those terms are commonly understood and used on the Internet.
• You will not host, display, upload, modify, publish, transmit, update or share any information that —
• (a) belongs to another person and to which the user does not have any right to;
• (b) is grossly harmful, harassing, blasphemous defamatory, obscene, pornographic, paedophilic, libellous, invasive of another's privacy, hateful, or racially, ethnically objectionable, disparaging, relating or encouraging money laundering or gambling, or otherwise unlawful in any manner whatever;
• (c) harm minors in any way;
• (d) infringes any patent, trademark, copyright or other proprietary rights(s), violates any law for the time being in force;
• (f) deceives or misleads the addressee about the origin of such messages or communicates any information which is grossly offensive or menacing in nature;
• (g) impersonate another person;
• (h) contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer resource ;
• (i) Threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign states, or public order or causes incitement to the commission of any cognizable offence or prevents investigation of any offence or is insulting any other nation.
Indemnification
You agree to indemnify Reksys for any breach of these App Terms. Qbust reserves the right to control the defence and settlement of any third party claim for which you indemnify Reksys under these App Terms and you will assist us in exercising such rights.
No Promises
Reksys Tech provides the App on an ‘as is’ and ‘as available’ basis without any promises or representations, express or implied. In particular, Reksys does not warrant or make any representation regarding the validity, accuracy, reliability or availability of the App or its content. To the fullest extent permitted by applicable law, Reksys hereby excludes all promises, whether express or implied, including any promises that the App is fit for purpose, of satisfactory quality, non-infringing, is free of defects, is able to operate on an uninterrupted basis, that the use of the App by you is in compliance with laws or that any information that you transmit in connection with this App will be successfully, accurately or securely transmitted.

1. If service providers do not arrive at the spot on time.
2. If the employees of the service providers or administration demonstrate rude behavior or misbehave with the customers.
3. If certain aspects of the service providers or administration such as services are not up to the customer's expectations.
4. If the service providers or administration cancels the appointments for reasons unknown.
5. If the baggage of a customer gets lost / stolen / damaged or accident of customer in the event of travel to service provider location.
6. If the service providers or administration changes a customer's appointment time at the last minute to accommodate a schedule .
7. If the customer waits at the wrong address.
8. If the service provider changes the appointment point.
9. Qbust shall not be responsible and shall not be required to mediate or resolve any dispute or disagreement between User and Service provider . In no event, shall Qbust be made a party to dispute between User(s) and Service Provider(s)
10.The timings of appointments are as per the scheduled timings of clinic. However, the service provider and administration may change the appointment timings or the appointments locations, or the service providers may get delayed due to unavoidable reasons such as traffic jams.
11.On the date of appointment, the customers are requested to check current status of their appointment to reconfirm their appointment time.
12.The User hereby assumes the sole risk of appointment booking or making use or relying on the information relating to the Services available on this Website/ Application. Qbust does not promote any service provider listed on the Website/ Application. It is User’s responsibility to check the details of the service provider listed on the Website/ Application at its sole discretion.
Content ownership and copyright
1. Content included on the Website, such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property of Qbust, its affiliates or its content suppliers and is protected by Indian and international copyright and database right laws.
2. The compilation of all content on this Website is the exclusive property of Website and its affiliates and is protected by laws of India and international copyright and database right laws. All software used on this Website is the property of Qbust and is protected by Indian and international copyright and authors' rights laws.
3. You may not systematically extract/or re-utilise any parts of the contents of the Website without our express written consent. In particular, You may not utilize any data mining, robots, or similar data gathering and extraction tools to extract (whether once or many times) for re-utilisation of any substantial parts of this Website, without Qbust's express written consent. You may also not create and/or publish your own database that features substantial (eg: prices and service listings) parts of the Website without Qbust's express written consent.
4. You cannot use the Qbust trademarks for commercially exploiting them for your interests without our express permission. We reserve the right to initiate legal proceedings if we discover any infringement of our intellectual property rights.
Suspension, Termination or Cancellation
Website may suspend, cancel or terminate your account registered with us, with or without prior notice, if we believe in good faith that you have breached any of these Terms or any other terms or policies referred to in these Terms. QBust reserves the right, at its sole discretion, to accept, hold and/or cancel any reservation of bus tickets made by the you on the QBust website, QBust mobile website and QBust mobile apps, which is deemed to be fraudulent or suspicious by QBust QBust will endeavour to inform you in the event of cancellation of reservation, owing to fraud or suspicious activity, to the best of its capacity, but shall not be liable for a failure to communicate to You of such cancellation.
Amendment / Modification:
QBust reserves the right to modify these Terms at any time with or without any further notice by uploading the revised Terms on the Website and it is your duty to keep yourself aware of the revisions to the Terms of the Website.
Correspondence/Notices:
When You use the App and Website or send emails or other data, information or communication to Qbust, You agree and understand that You are communicating with us through electronic records and You consent to receive communications via electronic means from Qbust periodically and as and when required.
2. We may communicate with you through email/SMS or by such other mode of communication, electronic or otherwise.
Losses:
Qbust will not be responsible for any loss (including loss of profits, revenue, contracts, anticipated savings, data, goodwill or wasted expenditure) and any other indirect or consequential loss to You when You commenced using the App or website.
Governing law and Jurisdiction:
These Terms are governed by and shall be construed in accordance with the laws of India. The courts in india shall have exclusive jurisdiction in respect of any disputes arising out of or in connection with these Terms.
Limitation Of Liability:
THE WEBSITE/QBUST APP WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND, INCLUDING WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, AND CONSEQUENTIAL DAMAGES, ARISING OUT OF OR IN CONNECTION WITH THE TERMS, SITE, FACILITY, TRANSACTION PROCESSING SERVICE, INABILITY TO USE THE FACILITY OR THE TRANSACTION PROCESSING SERVICE, OR THOSE RESULTING FROM ANY FACILITY PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH THE WEBSITE, BEYOND THE VALUE OF THE LAST TRANSACTION CARRIED OUT BY YOU THROUGH THE WEBSITE.
Miscellaneous:
1. The Parties acknowledge and accept that electronic format shall be deemed an acceptable means of communication for the purposes of these Terms.
2. These Terms constitute the complete and entire set of terms between the Parties on the subject of ‘terms of usage of the Website' (save and except the other policies and terms referred to in these Terms) and shall supersede any and all other prior understandings, commitments, representations or agreements, whether written or oral, between the Parties to these Terms.
3. If any provision of these Terms shall be found by any court or administrative body of competent jurisdiction to be invalid or unenforceable, such invalidity or enforceability shall not affect the other provisions of these Terms, which shall remain in full force and effect.
4. In no event will any delay, failure or omission (in whole or in part) in enforcing, exercising or pursuing any right, power, privilege, claim or remedy conferred by or arising under these Terms or by law, be deemed to be or construed as a waiver of that or any other right, so as to bar the enforcement of that, or any other right, power privilege, claim or remedy, in any other instance at any time or times subsequently.
Membership Eligibility:
1. Use of the App and Website is available only to persons who can enter into legally binding contracts under the applicable law. Persons who are "incompetent to contract" within the meaning of the applicable law are not eligible to use the Website. If you are a minor, you shall not register as a User of the App and Website and shall not transact on or use the Website.
2. As a minor if you wish to use or transact on the Website, such use or transaction may be made by your legal guardian or parents. We reserve the right to terminate your membership and/or refuse to provide you with access to the App and Website if it is discovered that you are a minor or incompetent to contract according to the law.

These Terms are an electronic record in terms of the applicable legislation. This electronic record is generated by a computer system and does not require any physical or digital signatures. By using the App or Website, you signify your agreement to be bound by these Terms.
Qbust allows You to surf the App and Website or App to book an appointment for yourself, your family and your friends, without registering on the Website. You shall be deemed to have read, understood and expressly accepted these Terms, which shall govern the desired transaction of appointment booking through the App for all purposes, and shall be binding on You. All Your rights and liabilities and/or the App with respect to Your use of the App and Website and App availing appointment booking facility ("Facility") provided by the App and Website and App shall be governed by these Terms.
PLEASE NOTE THAT YOUR USE OF THE APP AND APP AND WEBSITE IN ANY WAY SIGNIFIES YOUR ACCEPTANCE TO THE TERMS. By agreeing to these Terms, You also agree to Qbust' other App and Website policies; including but not limited to, (i) Privacy Policy, as amended from time to time; and (ii) Cookie Policy.
